Prize Drawing Dates: Grand Prize Sweepstakes ends on July 31, 2006 and the Grand Prize drawing will take place on or about August 15, 2006.
One entry is allowed per day per person during the Sweepstakes Period regardless of the method
One (1) Dell Computer/Snapple package will be awarded (includes one (1) Dimension B110 desktop PC, one (1) case of Snapple, and one (1) Snapple Mouse Pad, Total ARV of each $330.00) from each of the sixty (60) participating Brooklyn Public Library branches. ARV of all prizes $19,800.
Winners must be legal residents of New York or New Jersey and be 13 years old at time of participation to claim prize. If winners are under 18, prize will be awarded to a parent or guardian. Employees, officers and directors of Snapple Beverage Corp. (“Sponsor”) its licensed bottlers, and the Brooklyn Public Library, their respective parent, affiliated and subsidiary companies (collectively, the "Promotion Parties"), and their promotional partners, advertising and promotional agencies, broadcast affiliates, printers and suppliers of Sweepstakes and packaging materials, redemption/recycling centers, owners/operators and those responsible for making purchasing decisions relative to marketing and promotions of retail establishments that sell Sponsor products, persons engaged in the development of promotional materials, judging or administration organizations, or auditing or legal firms and members of any of the above's immediate family (parents, children, step-parents, step-children, siblings, step-siblings or spouses) or household members (whether or not related) of such employees, officers and directors are not eligible.
HOW TO ENTER:
During the Sweepstakes Period, you can enter in either of the following ways:
1. Go to any participating Brooklyn Public Library and use your ABC card (Brooklyn Public Library card and proprietary debit card used for Brooklyn Public Library services) in the Snapple vending machine, to be automatically entered in that library branch drawing when you purchase a Snapple.
2. Complete and mail in a Snapple/Brooklyn Public Library entry form found at any participating Brooklyn Public Library or a 3” x 5” card with your name, address, city, state, zip and age Snapple/Brooklyn Public Library Sweepstakes P.O. Box 77922, Baton Rouge, LA 70879-7922. The 3” X 5” cards will be entered in the branch drawing closest to your residence.
SELECTION OF WINNERS:
One winner will be chosen randomly by an independent agency from each branch. Odds of winning depend on number of entries received per branch.
HOW TO CLAIM A PRIZE:
Grand Prize – Entries will be segregated by the particular branch of the Brooklyn Public Library from which the entries are received. Each Grand Prize winner will be notified via mail of his/her potential winning status, and before the prize is awarded, must sign and return an Affidavit of Eligibility and Liability Release (“Affidavit”) (where lawful) and return it within 14 days after notification. Failure to return the Affidavit within 14 days may result in prize forfeiture. An alternate winner may be selected at Sponsor’s sole discretion. If mail is returned as undeliverable without a forwarding address, then prize may be forfeited. Prize will be awarded upon receipt of Affidavit and verification of prize winner. If winner is under the age of 18 at time of entry, parent or guardian must complete and return affidavit. Odds of winning depend on the number of entries received, per library branch. In the event of a dispute, prize will be awarded to the ABC card holder.
By participating, you accept and agree to abide by these Official Rules and all decisions of Sponsor and its independent judging and administration organizations, which are final and legally binding in all respects. No substitution of prize is offered, no transfer of all or any part of prize to a third party permitted. In the event that the prize cannot be awarded for any reason or winner is not capable of redeeming prize for any reason, then neither Sponsor, Brooklyn Public Library nor any of the Promotion Parties shall be obligated to award any prize and Sponsor reserves the right, in its sole discretion, whether or not to substitute the prize (or portion of prize) with a prize of comparable or greater value or cash value. The prize recipient is responsible for all applicable federal, state, territorial and local taxes, if any, on prize and any other expenses not specified herein as being awarded are solely the responsibility of the winner by Sponsor. Non-compliance with these Official Rules may result in disqualification. You are not a winner until your entry has verified in accordance with these Official Rules, and you have fully complied with these Official Rules. By entering this Sweepstakes and/or accepting a prize and/or participating in any prize event, you hereby release Sponsor and its licensed bottlers and all of their respective parents, affiliates and subsidiary companies, broadcast affiliates, advertising and promotions agencies, and all of their respective employees, officers, shareholders, directors and agents (collectively, “Releasees”) from (i) any and all liability, loss, harm, damage, cost or expense, including, but not limited to, all reasonable counsel fees and court costs incurred, property damage, personal injury and/or death; (ii) anything related to the production, promotion, or execution of this Sweepstakes (or your participation therein), including preemption, cancellation, or rescheduling of any show; (iii) that which may occur in connection with acceptance and/or use of the prize or while participating in or traveling to any Sweepstakes-related activity. Acceptance of any prize constitutes permission for Sponsor and its designees to use winner’s name and/or likeness for purposes of advertising and trade in any medium, without further compensation, unless prohibited by law. Limit of one prize per family, household, or organization. Prizes will be awarded as is without any warranty expressed or implied.
All Entries are subject to verification at the sole discretion of Sponsor. Anti-fraud detection devices may be used for verification purposes. Except as expressly stated above, Sponsor shall have no liability or obligation with respect to any void entries. In no event will Sponsor be obligated to award more prizes than the number of prizes stated in these Official Rules. If for any reason, whatsoever Sponsor determines in its sole discretion that the sweepstakes is no longer capable of running as intended by these rules, Sponsor may at its sole discretion cancel, suspend or modify the sweepstakes in whole or in part.
LIMITATIONS OF LIABILITY:
Neither Sponsor nor any other Releasee is responsible for lost, late, incomplete, stolen, misdirected, or illegible, postage due mail or human error that may occur in the receipt or processing of the entries, other submission or correspondence, shipping. Any use of photocopies or like entry methods will void all such entries by such methods, and disqualify any participant using such methods.
IN NO EVENT WILL SPONSOR OR ANY OTHER RELEASEE BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, CLAIMS, ACTIONS, DAMAGES, LOSSES OR LIABILITY OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES RESULTING FROM OR ARISING FROM YOUR PARTICIPATION IN, OR THE PRODUCTION, PROMOTION OR ADMINISTRATION OF, THE SWEEPSTAKES, OR ACCEPTANCE, POSSESSION, USE, MISUSE, OR NONUSE OF THE PRIZE THAT MAY BE AWARDED. ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT/INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. The 2006 Snapple Summer Reading Real Fact Contest (the “Contest”) is open to individuals who are legal residents of New York and New Jersey and are at least 9 years old at the time of participation in contest. Void outside New York and New Jersey and where prohibited by law. Employees of Snapple Beverage Corporation, Brooklyn Public Library and their respective parents, affiliates, subsidiaries, divisions, and advertising and promotion agencies, and members of their immediate families (children and siblings) and persons living in the same household of each, are not eligible to enter or win. A minor should have his/her parent’s or legal guardian’s permission to enter. This Contest is subject to all applicable federal, state, and local laws. By participating, you (and, if an eligible minor, your parent or legal guardian) agree to these Official Rules and to the decisions of the Sponsor and independent judges, which are final and binding in all respects. Sponsor reserves the right to verify eligibility qualifications of the winner.
HOW TO ENTER:
During the Entry Period (6/8/06 to 8/11/06), to enter the Contest, complete the Snapple 2006 Summer Reading “Real Fact” Contest Official Entry Form available at participating Brooklyn Public Library branches. Complete Official Entry Form by providing your first and last name, complete address, age, phone number (including area code) and by submitting a “Real Fact” (a factual statement that can be verified by multiple sources). Entries must be submitted to a participating Brooklyn Public Library branch by August 11, 2006. Limit one (1) entry per person. Entries generated by script, macro or other automated means will be void. All entries become the property of the Sponsor and will not be returned. If under 18 you must have parent or guardian’s permission to enter.
Entry must be entrant’s own original work, be in keeping with the Sponsor’s image and may not be offensive, as determined by the Sponsor in its sole discretion, nor can it defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or property rights or any other third party rights. Sponsor reserves the right to disqualify any entry it deems to be inappropriate, offensive or is not in keeping with Sponsor’s image, in its sole discretion. Real Fact must not exceed 100 characters including spaces. Winning Real Fact may be edited due to space constraints.
All eligible entries will be reviewed and judged by qualified independent judges based on the following criteria: Originality (40%), Appropriateness (30%) and In keeping with Snapple tone and image (30%). In the event of a tie, an additional, qualified, “tie-breaking” judge shall determine the winner from such tied entries using the criteria herein. Sponsor reserves the right to not award the prize if, in its sole discretion, it does not receive a sufficient number of qualified entries. Decisions of the judges are final and binding.
Potential winner will be notified by mail, phone and/or e-mail and will be required to sign and return an affidavit of eligibility and liability release, applicable tax releases and (where legal) publicity release within ten (10) days of issuance. If a potential winner fails to timely return such documents, any prize or prize notification is returned as undeliverable, chooses to decline a prize for any reason, or fails to comply with these Official Rules, the prize may be forfeited and, at Sponsor’s discretion, awarded to the runner-up. If winner is an eligible minor, prize may at Sponsor’s discretion be awarded in the name of the parent or legal guardian and such parent or legal guardian will be required to fulfill all requirements set forth herein, including, but not limited to, signing and returning affidavit/release(s) within ten (10) days of issuance.
All entrants will receive a Snapple bookmark and certificate of creativity (one per person, while supplies last) at the time entry is submitted. The Real Fact of One (1) Grand Prize winner will be printed under selected Snapple caps in market during 2007. One Grand Prize winner will also receive one (1) Dell Computer Dimension B110 desktop PC ARV $300. The prize is only as detailed above, with no substitution, cash equivalent or transfer of prize permitted by winner. Sponsor reserves the right to substitute a prize of comparable or greater value, at its sole discretion. Prize will be awarded “as is” without any warranty, expressed or implied. Winner is solely responsible for paying all applicable federal, state, and local taxes, if any, and all other costs or expenses associated with the acceptance and use of the prize not explicitly stated herein as being awarded.
By submitting a entry, each entrant (or, if a minor, the parent or legal guardian) agrees Sponsor shall own the entry submitted (including all rights embodied therein) and that it and its designees may exploit all elements of such entry in any and all media now known or not currently known, worldwide in perpetuity, without compensation, notification or permission to entrant or any third party. The Sponsor reserves all rights, including the right to edit, publish, use, adapt, exploit, modify or dispose of any entry, online, in print, film, television, or in any other media now or hereafter known for advertising and promotional or other purposes throughout the world in perpetuity without compensation, permission or notification to the entrant of any kind, except as prohibited by law.
LIMITATIONS OF LIABILITY:
Acceptance of a prize constitutes permission for Sponsor and its designees to use winner’s name and likeness for advertising and promotional purposes in any and all media now or hereafter known throughout the world in perpetuity at discretion of Sponsor without compensation, notification permission, unless otherwise prohibited by law. Sponsor and Brooklyn Public Library, and their respective parents, affiliates, divisions, subsidiaries, and advertising and promotions agencies, and the respective officers, directors, shareholders, agents, and employees of each of the foregoing (the “Released Parties”) are not responsible for late, lost, illegible, or misdirected mail.

Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner.
